Terms of Service
Last updated: [DATE]
These Terms govern your use of the Mamago mobile wallet ("Mamago"), provided by VAC Digital Culture Technology Group Company Limited ("we", "us"). By using Mamago you agree to them.
1. What Mamago is
Mamago is self-custody wallet software. It generates and stores cryptographic keys on your device and helps you view balances and sign blockchain transactions.
Mamago is not a bank, exchange, broker, or money transmitter. We do not hold your assets, do not take deposits, do not exchange currencies, and do not execute trades on your behalf. We never have possession of or control over your funds at any time. If you use the optional energy rental feature (§3), our gateway passes your order and the payment you signed to the provider; the payment goes from your address to the provider's address, never to us.
2. Your keys, your responsibility
This is the most important section. Please read it.
- You alone control your recovery phrase and private keys. They are stored on your device and are never sent to us.
- We cannot recover them. If you lose your recovery phrase and lose access to your device, your funds are permanently inaccessible — to you and to everyone else, including us. There is no password reset, no support process, and no legal mechanism that can restore them.
- Anyone who obtains your recovery phrase controls your funds. Never share it. We will never ask you for it. Anyone who does — including anyone claiming to be us — is attempting to steal from you.
- Blockchain transactions are irreversible. Once broadcast, a transaction cannot be cancelled or reversed — by us or by anyone. Verify the recipient address and amount before signing.
3. Third-party networks and applications
Mamago interacts with public blockchains, public node providers, data providers, and — if you choose to pair with them — third-party applications over WalletConnect. None of these are operated or controlled by us. We are not responsible for their availability, accuracy, fees, security, or conduct.
Mamago displays warnings for certain transaction patterns and rejects signature requests for addresses your wallet does not own. These are best-effort safety aids, not guarantees. A transaction that produces no warning is not thereby safe.
Energy rental on TRON. Mamago's optional Energy screen lets you rent TRON energy from TronSave, an independent provider that we do not operate or control. TronSave sets the price, provides the energy and decides whether to deliver it; we take no commission. When you confirm a rental, Mamago builds an ordinary TRX payment from your address to TronSave's address, you sign it on your device, and our gateway passes it to TronSave together with your address and the rental details. TronSave submits the payment to the TRON network and delegates the energy to your address. Your payment goes to TronSave, not to us. Once it is on the blockchain it cannot be reversed, and we cannot get it back from TronSave or make TronSave deliver. Our part is to show you the quote TronSave gives us, to build the payment you confirm, and to pass your order to TronSave as you confirmed it; §6 explains our responsibility if we get that wrong.
4. Acceptable use
You agree not to use Mamago to break any law that applies to you, and not to attempt to interfere with, reverse engineer for the purpose of attacking, or gain unauthorized access to Mamago or our gateway infrastructure.
Sanctions. We are a Hong Kong company, and we must comply with the sanctions that apply to us, including sanctions imposed by the United Nations Security Council as implemented in Hong Kong. The companies that distribute Mamago and provide the services our gateway relies on are also subject to sanctions laws, including those of the United States.
By using Mamago, you confirm that:
- you are not named on a sanctions list maintained by the United Nations Security Council, the United States, the European Union or the United Kingdom, and you are not owned or controlled by, or acting on behalf of, anyone who is; and
- you are not located in, or ordinarily resident in, a country or region that is subject to comprehensive sanctions — a ban on almost all trade with that place — imposed by any of those authorities.
Sanctions that target particular people or organisations do not, by themselves, prevent other people in the same country from using Mamago.
You also agree not to use Mamago in a way that would break sanctions that apply to you, or cause us to break sanctions that apply to us.
What we can and cannot check. Mamago has no accounts and does not ask who you are or where you are, so we cannot verify what you confirm above, and we do not promise to check it.
We may stop providing our gateway, or refuse a particular request to it, where we reasonably believe we must do so to comply with sanctions or other law that applies to us — for example, a request involving an address that appears on a sanctions list. Mamago may also not be offered in some countries or regions. Stopping our gateway does not give us any control over your funds: your keys stay on your device, and you can still use your recovery phrase with other wallet software that supports it. Features that depend on our gateway, such as transaction history, prices and energy rental, may stop working in Mamago.
5. What we promise, and what we do not
We will use reasonable care and skill in building Mamago and in running our gateway.
Beyond that, Mamago is provided "as is" and "as available". Software can have defects and networks can fail, so we do not promise that Mamago or our gateway will always be available, will be free of errors or vulnerabilities, or will suit your particular needs. To the extent the law that applies to you allows, we make no other promises about Mamago, whether stated or implied.
This section is subject to §6.4.
6. Responsibility for losses
6.1 Losses we cause. If we fail to use reasonable care and skill in building Mamago or in running our gateway, or we break these Terms, we are responsible for the loss you suffer as a result, where that loss was a reasonably foreseeable consequence of our failure. For example, this covers loss caused by a defect in Mamago or our gateway that:
- builds a transaction with a different amount or recipient from the one Mamago showed you before you signed it;
- derives an address that your recovery phrase does not control, so that funds sent to it cannot be reached; or
- passes an energy rental order to the provider with details different from the ones you confirmed.
6.2 Losses we do not cause. We are not responsible for loss to the extent that it is caused by:
- your recovery phrase, private keys, password or unlocked device being lost, or being obtained by someone else, unless that happened because of a defect in Mamago;
- a transaction or message you signed, where Mamago built it as it showed it to you — for example a payment to an address you entered or chose, or a request you approved from an application you paired with;
- a blockchain, node provider, data provider, WalletConnect, an application you paired with, TronSave, or any other third party described in §3 — including their outages, errors, fees and prices, and whether TronSave delivers energy you paid for; or
- events beyond our reasonable control.
Where a loss has more than one cause and one of them is ours, we are responsible for the part of the loss that our failure caused.
6.3 Kinds of loss. We are not responsible for loss that was not a reasonably foreseeable consequence of our failure. If you use Mamago for a business, we are also not responsible for loss of profit, business or opportunity.
6.4 What these Terms never limit. Nothing in these Terms, including §5 and this §6, excludes or limits:
- our liability for death or personal injury caused by our negligence;
- our liability for fraud, including fraudulent misrepresentation; or
- any other liability, or any right you have, that cannot be excluded or limited under the law that applies to you.
If the law that applies to you does not allow part of §5 or §6 to apply to you, that part applies only as far as that law allows, and the rest continues to apply.
7. Open-source components
Mamago includes third-party open-source software. Their licenses are available in the app under Settings → About → Open-source licenses.
8. Changes
We may update these Terms. Continued use after an update constitutes acceptance.
These Terms may be provided in other languages. If a translation differs from the English version, the English version prevails.
9. Governing law and disputes
These Terms are governed by the laws of the Hong Kong Special Administrative Region.
If you use Mamago as a consumer, this choice of law does not take away any protection you have under the laws of the country where you live that cannot be waived or changed by agreement. Where those laws give you a right, you keep it.
If you have a problem with Mamago, please contact us first at hello@vac.asia and we will try to resolve it. This is an invitation, not a condition: you do not have to contact us before bringing a claim.
The courts of Hong Kong have jurisdiction over any dispute arising out of or relating to these Terms or Mamago. This jurisdiction is non-exclusive. If you are a consumer, you may also bring a claim in the courts of the country where you live, or use a consumer complaint procedure available there, where the law of that country allows it. Smaller claims may be brought in the Hong Kong Small Claims Tribunal.
